My Checks are encased on Saturday 09/15th. My Applications received nebraska on July 20th. Since My I-140 is from Texas, the case transferred to Texas.
Just Checks are cashed, not yet recieved any Receipt Notices yet.

Hi,
If the Dems win control of the Senate, I expect no major changes for us. The amnesty bills are already passed easily in the Senate as is anyway. That doesn't change anything for us there.
In the House, this will be a close race. Even if Dems barely win in the House, what is less likely, then they may well find themselves struggling again to get major votes for the amnesty bills. Remember that the amnesty bills got rejected in the House by large margin - and - enforcement only bills got approved there widely. Our stand alone SKULL bill - not sure whether that will be considered by Democrats. Democrats will probably address the Dream Act before they take over the SKULL bill. Let them pass Dream Act, and then we, the Employment Base applicants will be in a real dream for a long time.
It won't be easy, folks.

We have been waiting for more than 100 days. We applied exactly 120 days before our current EAD was going to expire. When I called USCIS (after 90 days) , Customer Service told that that don�t have our finger prints in file. I never got any notice and my lawyer said they don�t need finger prints for paper filed application and they should use I485 finger prints. So I took the infopass appointment. IO was nice and he was willing to listen. He said the same thing (missing finger prints). I showed him the fingerprint receipts from last year and also showed the USCIS memo talking about interim EAD. He said no to interim EAD. But called Texas Service Center right then. Person on the other end offered to call back in 5 minutes and he did. IO came back and told us that there was some thing wrong at their end and they will port my finger print information from 485 to EAD application. But he said it would take 10 � 15 business days more. Our current EAD were expiring soon and I called congresswoman�s office next day. Got the approval email yesterday evening. Don�t know what worked. But what a huge relief.

First and foremost we have to realize that we are fee paying customers to USCIS. We have a right to demand better customer service. The reports and other kind of data they are releasing currently is an insult to the high skilled immigrant community. It is time we call out that the king (USCIS) has no clothes. They have been feeding us garbage disguised as reports and offical data. Anybody with a high school degree would say that the reports and data provided have zero value since they are not complete.
How do we get the right kind of information from USCIS?
Here are the steps
a) Send letters to the Dept chief asking for the data we need and wait for 3-4 weeks for a response. ( Data we should ask for, apps pending with PD's and EB category for every month starting from 1998)
b) Send another letter to the President and copy USCIS chief on that. Wait for another 3-4 weeks
c) If we do not get any satisfactory information after the previous 2 steps and 2 months of waiting, we should do a relay protest in DC and in front of all the USCIS centers until they provide us with the exact data.
By doing this we woould have put enough spotlight on USCIS and also our problmes would have got enough coverage in the media. From here we can try and work with the various agencies to push for our other agendas. Now we will have a clearer picture of what the situation is and ask for the right things. At the same time the agencies will have the better information with them to look in to our issues.
Comments are welcome.
CIS is answerable to nobody. While they will be more responsive to complaints and suggestions at a broad level, individual case processing is something that can't be controlled.
It is a problem of ridiculous amount of power in the hands of people who can't handle it - the IOs. They can do anything. It is not hard for them to justify saying the older cases are complex, whereas in reality, it might a case of plain laziness to go fetch the case files.
So, if they are processing at random, there is nothing we can do except zip up, pray and wait for luck to turn our way.

My employer is also behaving exactly similar way... Spend the money from your own Pocket ( 350 med + 385 ) around $750 and ask them to just
give the Future Employment Verification Letter for 485.
I'm finishing up all forms and other activities Like Medical , Birth Certificate etc..

It was expected that a pro illegal immigration leglistation would not pass this year. That is not my major concern. My concern is that if most pro amnesty/CIR incumbents get replaced coming November based on their immigration records, that will make passage of future pro immigration bills even harder. I believe that the fight to attach the illegal alien cause to the legal one may be around for a while. I am afraid that this cycle of defeats may be extended for few more rounds until a bill is passed or people give up from mixing legal and illegal cause. There is no sign yet that major lobbysts - AILA, etc - are giving up from the idea of attaching illegal and legal alien cause. By the way, according to numbersusa.com, AILA drafted most of the McCain/Kennedy amnesty bill. Mind you.
I heard Sen. King and others saying that the enforcement should be increased. Only 3-5 years later a bill should be discussed to see what to do with the illegal folks who are left here.

I personally feel nothing much might be accomplished this year. A lot is at stake for politicians if they take any position. Thus dragging the issue and dealing with it next year seems to be their only option. It is a bad sign for lots of legal immigrants who have been anxiously waiting all this while. If at all anything can happen, it will only be due to initiative from the President. Or if President signs a emergency bill giving relief to outstanding, highly educated people who have been in line. This option maybe a daydream but will keep us optimistic until November this year. Sorry for sounding pessimistic.

I was never a fatalist but the GC process made me one... to a certain extent... Came to US in 96 as a student... First PD 1999... layoff in 2001... 2nd PD 2002... company shut down... 3rd PD 2003... PD cleared 7 days after 2005 retro! That was the worst period and I was so frustrated at the time!June 1st 07 filer... Was waiting for FP, EAD forever. Finally on sept 13th I had my FP and sept 17th my GC... just like that... no LUD, EAD, AP nothing... directly GC in the mail... I guess it was just my time! Looking back I think I am glad I concentrated on the positives that were going on in my life... thats pretty much the only thing one can do to aviod frustration... IV is a great organization and hopefully their efforts will bring fruits! Meanwhile good luck to u!

Up until July 29, 2007 (incl.) when sorting of files was going on, NSC did a load sharing of files with TSC. (and btw they did not look at where ones' I-140 is adjudicated when making the selection, it was random. I know several such cases)
This in my opinion is a very good way of making sure adjudicating resources are kept in balance at both centers.
Like somone quiet rightly pointed out it is akin to the old Labor Certification process where some states were way faster than others (less demand faster process).
In the direct filing which started July 30, 2007 the load sharing has a great possibilty of being tilted one way or the other (though maybe not as much as old LC's). They have made a geographical distribution and not one that factors # of applications traditionally received from states.
On the other hand, may be USCIS has figured that the particular geographical jurisdiction produces the right load sharing between NSC and TSC!

Exactly! And thanks for clarifying that, which is what I've been trying to convey for the past 2 days! In your cook example, though, the cook can be self-employed with no income in a given period (week/month)--and he does not need to line up contracts. His business is "legitimate" and is in the same occupation as on his I140 petition. For an RFE-EVL, which he can write on his business "letterhead," all he needs to mention is his "projected" yearly income as salary.
USCIS may not buy if no income shown thro the bussiness. One may have a simple bussiness model. However, they should be in a position to show documentary evidence that they are making similar money as per 140, and importantly they are doing same kind of work when self employed, and they have a long term commitment/contract for their bussiness. Then only they may belief that you are doing legitimate bussiness thro self employment. Just writing EVL in a letter head will not serve the purpose.
USCIS may not buy if no income shown thro the bussiness. One may have a simple bussiness model. However, they should be in a position to show documentary evidence that they are making similar money as per 140, and importantly they are doing same kind of work when self employed, and they have a long term commitment/contract for their bussiness. However, I also believe we should significantly enhance the American labor market by placing a priority on educating U.S. students and training American workers instead of fostering a reliance on foreign workers. Businesses seeking to hire a temporary professional worker should pledge that they have made a good-faith effort to hire U.S. workers first and that the temporary professional worker will not displace a U.S. worker. I believe that these provisions can be met without stifling business and economic growth.
In addition, true border security can come only from the increased use of manpower and effective technology together with an efficient and judicious legal immigration application process. CIR is not going to happen, even if it happens there will be nothing for Employment Based Legal Immigration.
Any large immigration overhaul is not going to work in current economic climate.
And yes, you can not file a law suit for a law that we all were aware of while entering this country. No doubt those who are waiting for long time and are in the country for long time are in miserable condition but I don't think law suit is an option. But I certainly believe government is not aware of true picture of this situation.
I would like to take initiative and present the situation to senate and president's office. However I don't want to do this without approval of senior IV members. This would help those who are in country for long time and have been waiting for long time.
