Come on Guys,
We need more people to break the USCIS back. We can do it. It will not only help people who are currently facing the repercussion of this unreasonable USCIS actions, it will help others. Just think about, It could help your friends, relatives, brothers, sisters, cousins and all people....
This effort is to raise our voice towards the unfair treatment we have been receiving from USCIS since 2002. The First was the huge labor backlog, then came the ever-pending NameChecks, then came the July 2007 fiasco, then the approval of cases based on 485 ND and RD when people with PD < 2004 are waiting for years, then the frequent retrogressions. There are lot of people who got a single year EAD because PD was current till 2006 until last month. Now the dates have gone back to 2003 and no one knows when it will reach 2006 again. This is ridiculous. We need to raise our voice, otherwise, we will not see any light in the future. This is a nice opportunity to come together guys. COME UNITED guys.

We'll do these things for common/generic issues like visa recapture,not counting dependents visas,removing per country quota.
#1.EB3s will start contributing , let's say $100 Each
#2.EB2s will match the amount in #1
#3.GC holders(Both EB2&EB3 - IV members) will contribute $250 to help their IV friends.

My status on CRIS has changed. No emails. Its says my approval has been sent. But nothing about the card. I spoke to the CS and they said my biometrics have to be uploaded. In the mean time can I get my passport stamped?
One of my friend was in your situation. He got the I797 stating that 485 was approved. He took infopass and got the passport stamped. Hope this helps.

Listen, everyone is frustrated but to take your lives for a GC is crazy. If you guys are so depressed please seek medical help. If you have kids they will be US citizens they can sponsor you 18 years later so why are you that frustrated. When your wife is on H4 that is the best time to have kids because she is at home and you don't have to pay daycare. It is the woman in H1B that my sympathies are with bc they cannot go part-time or get more that 6 week maternity leave. So please buckle up or seek help, I don’t think your logic makes sense.
I tend to agree that suicidal thoughts borne out of frustration is totally crazy. Look at the Irish. They are illegals, yet they go to capitol Hill and themselves talk to lawmakers. And then probably in the evening, they might have drunk to that. Do you think they think like that...?:
Yes, if suicide is something that crosses your mind due to GC frustration, I think you need to seek professional help from a therapist. Because mental health is of higher priority than immigration status.
Putting off raising a family, having kids etc UNTIL you get GC is also not wise. Do you really want to tie that important decision of life with the process that's decided in the halls of congress?
Another thing...if you are from India and China, then I suggest you do this. Go to Barnes and Noble, and pick up one of the two books (or both).

Although no. of visas are awarded "EB category + country" wise, but spillover is not awarded in same fashion.
.e.g. 3000 visa comes to EB2 I & 3000 visa comes to EB3 I.
But spillover comes from EB1 to EB2 irrespective of country. And reason why EB2 I is far ahead is because of spillover gain before it reaches to EB3.
Even if some EB2 I guys are not happy with EB3 person porting to EB2, shouldn't they calm down as whoever is porting taking benefit from spillover for EB2 world and not from spillover EB2 I.
My assumption is spillover comes to "EB2" and not "EB2 + country" wise, if that is not correct then my point is nullified.
The number of visas are awared "(EB + FB) Country" wise. The 7% limit is on the total green cards issued to a country regardless of category. There are two types of spillovers
1) The spillover from EB1 -> EB2
2) The spillover from FB -> EB
In the first scenario the spill over happens from EB1 to EB2 regardless of category, the spillover visas do not have any country cap or other limitations and hence are awarded to the oldest priority date applicants in the EB2 category. (This is why China doesnt support country cap removal as USCIS gives the oldest application the highest priority and most of the older applications are from India). IFF all the EB2 categories are current and there are no more pending EB2 applications the visa numbers spill over to the next category i.e. EB3. Therefore until all of EB2 is current EB3 will not receive any spillover visas.
In the second scenario the spill over happens between the FB and EB categories. If a certain country has not used up its entire FB quota additional number of EB visa's will be made available to the applicants of that country. e.g. If Korea has a total limit of 100 visas, which are evenly split between the EB and FB categories so they each have a limit of 50 visas. Only 20 people applied in the FB categories but 80 people applied in the EB categories. USCIS will approve all those applications even though the EB applicants far exceeded the EB limit.

I can tell you there are roughly 100,000 labor applications filed (50,000 EB3) between Aug 2003 and Dec 2003 for EB India category. The reason was everybody wanted to clear thru regular process before PERM takes over. Those Labors filed after Aug 2003 and before PERM started are moved into backlog and are fully cleary last 4 th quarter. And so 90% of those EB3s may be still there (45,000) hanging. EB2s could have been cleared substantially till Dec 2003. It is all my guess work and not sceintific or factual. also ..this looks very inaccurate ..because I know lot of indians who got H1 during the peak (when h1 was 195k) have gone back. i.e either they got better oppurtunities back home or just went back as they were not getting jobs. I did stay in one of the guest house which had lots of consultants ..none of them are here anymore !!

Excluding dependents is the most powerful and least controversial and most unifying way to clear the entire backlog in 2 - 3 years time. This way no EB2-EB3, I/C/ROW we will all be green.

Another suggestion is that porting should be automatic. As soon as a person acquires the required qualification for EB2 + a letter from the company that the person's future job will be of EB2 caliber, UCSIS should put him/her in EB2 category. This is some thing we should work on.
Most of us are analyst by profession. Maybe that is one of the reasons most of us are always engaged in analysis and optimization of the system, to suit our own individual application. All of us believe that the system which suits our individual application is the best system. Anything that doesn't work for us is just screwed-up. Every person is at a different stage so most of the people are always fighting with each other.

When you think about it, reservation and quota system is actually a better deal for the upper caste.

As per the above picture, 52% of people in India belongs to Backward classes according to Mandal estimates. Since the proposed reservation for them is 27%, the reservation system works in favor of Forward classes as long as Backward classes are not uplifted from their current pathetic situation. Another way of looking at the graph is that 25.5% of people in India belongs to forward classes; and their share in the Indian pie in terms of higher education of job opportunities --> (100 - 27 - 22.5 = 50.5%). Personally I like this system, than 25.5% of us getting only 25.5% of our share.
To conclude:
If reservations stays; 25% upper caste can enjoy 50% of resources.

Is there any way we can work for our US employer from India on Indian salary? I am thinking a consulting company with presence in US and India (Manpower??) can set this up for us. So we will just be living in India and working remotely for the employer as a consultant. We will be paying indian taxes as the consulting company will be indian. Any thoughts?
